These Terms of Service ("Terms") govern your access to and use of ContactFlow.ai ("we," "us," or "our"), an AI agent platform for voice and chat communications. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of ContactFlow.ai, you confirm that you have read, understood, and agree to these Terms. We may update them at any time. Continued use after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

ContactFlow.ai provides an AI-powered platform that allows users to configure, deploy, and manage AI agents for voice calls (inbound and outbound) and chat channels including WhatsApp and web chat. The platform supports both prompt-based and flow-based agent configuration, and includes a built-in CRM for contact and workspace management.

3. Accounts and Workspaces

You are responsible for maintaining the security of your account credentials. Each workspace you create is your responsibility. You may not share credentials with unauthorized parties. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use ContactFlow.ai to:

  • Make unsolicited, harassing, or fraudulent calls or messages.
  • Impersonate individuals, companies, or government entities.
  • Violate any applicable laws, including telemarketing, anti-spam, or consumer protection regulations.
  • Transmit malware, disrupt the platform, or attempt unauthorized access.
  • Collect or harvest personal data from others without lawful basis.
  • Use AI agents for any purpose that is deceptive, illegal, or harmful.

Violations may result in immediate account suspension without refund and, where applicable, referral to relevant authorities.

5. AI Agents and Conversations

You are solely responsible for the content of prompts, flows, and conversations your agents conduct. ContactFlow.ai provides the infrastructure and AI capabilities; we do not review or endorse the specific instructions you configure. Ensure all agent interactions comply with applicable laws in every jurisdiction where your agents operate.

Conversation data processed through your agents may be transmitted to third-party AI providers (such as OpenAI) to generate responses. By using the Service, you authorize this processing as described in our Privacy Policy.

6. Intellectual Property

All technology, branding, and content that makes up the ContactFlow.ai platform is owned by us or our licensors. You retain ownership of any prompts, flows, and contact data you create or upload. You grant us a limited license to process that content solely to deliver the Service.

7. Third-Party Services

The platform integrates with third-party providers including telephony services (for voice calls) and messaging platforms (for chat). Your use of these integrations is also subject to those providers' terms. We are not responsible for the availability or conduct of third-party services.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.

9. Pricing and Billing

Pricing is subject to the plan you select at signup or as agreed separately. We reserve the right to change pricing with reasonable notice. Continued use after a pricing change constitutes acceptance of the new rates.

10. Limitation of Liability

To the maximum extent permitted by law, ContactFlow.ai and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless ContactFlow.ai and its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your agents' interactions with third parties.

12. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes may be submitted to binding arbitration or a court of competent jurisdiction.
